User Agreement

  1. General
    1. Media Alliance Limited Liability Company, incorporated under the laws of the Russian Federation on 11 November 2009, Primary State Registration Number 1097746703130, hereinafter referred to as Media Alliance, offers any Internet user  (hereinafter referred to as the User), intending to access the website with the domain name http://mediaalliance.ru/en (hereinafter referred to as the Website), to access the Website and make any related actions on the terms and conditions set forth in this User Agreement (hereinafter referred to as the Agreement).
    2. This Agreement applies to relations between Media Alliance and any User who accesses the Website (regardless of the technology and method by which such access is made) and becomes effective from the moment the User makes the first access.
    3. Media Alliance may amend this Agreement at any time without any special notice. The new version of the Agreement shall enter into force and effect from the moment it is posted on the Website at the address specified in this paragraph, unless otherwise provided for in the new version of the Agreement. The current version of this Agreement is available at http://mediaalliance.ru/en/confidentiality policy/.
    4. If the User does not accept the terms and conditions of this Agreement or the terms and conditions of the new version of the Agreement, adopted in accordance with paragraph  1.3. hereof, the User shall immediately discontinue accessing the Website (stop visiting it).
    5. The Website may lack some of the features mentioned herein. At the same time, the use of certain Website features, services or extra services provided by Media Alliance, its affiliates and/or partners using the Website, as well as participation in promotions, contests, drawings, etc., held by the said persons with the use of the Website, may be subject to additional or separate rules and conditions, which the User will have to read, understand and accept in order to use and/or participate in the above.
  2. Access to the Website
    1. The User agrees to comply with the applicable laws of the Russian Federation and any other applicable legislation, as well as provisions of this Agreement, when accessing the Website and making any related actions.
    2. The Website is provided to the User on an “as is” basis. Media Alliance assumes no responsibility for the compliance of the Website content with the User’s requirements, needs or expectations. The User accesses the Website on his/her own initiative and at his/her own risk. Media Alliance does not guarantee continuous, instant, secure and error-free availability of the Website. Media Alliance shall not be liable for any losses incurred by the User as a result of accessing the Website or in connection with its authorised or unauthorized use by the User, including, but not limited to, damage to the User's equipment or to third parties, loss of data or any other damage.
    3. The Website may contain advertising materials, advertised by Media Alliance, its affiliates or partners. In this regard, the User hereby gives its consent to receive advertising information and messages in the manner provided for by para. 1, Art. 18 of Federal Law on Advertising No. 38-FZ dated 13 March 2006.
    4. The User is solely responsible to third parties for his/her actions related to accessing the Website and using its individual features, including if such actions result in violation of the third party rights and legitimate interests, as well as for compliance with the law in accessing the Website and related actions.
  3. Intellectual Property
    1. The Website, its content and all its elements, including, but not limited to, all materials, articles, drawings, graphics, design, audio and video materials, as well as the source code and object code of such part of the Website that can be recognised as a computer program, are items covered by exclusive rights owned by Media Alliance, its affiliates or other rightholders.
    2. Unless otherwise expressly stipulated by relevant terms of use of certain Website features or sections, neither Website elements nor its content may be used by the User without the prior permission of the respective rightholder, except as provided by the applicable laws of the Russian Federation.
  4. Third Party Websites and Content. User’s Content
    1. The Website may contain links to other websites (third party websites). Neither these third parties nor the content posted by them on the Internet are checked by Media Alliance for compliance with any requirements, including requirements for reliability, completeness, legality, etc. Media Alliance is not responsible for any information and materials posted on third party websites, which the User can access through the Website, including any opinions or statements expressed on third-party sites, advertising, etc., as well as for availability of such websites or content and the consequences of their use by the User.
    2. Any link (in any form) to any website, product, service or any information of a commercial or non-commercial nature posted on the Website shall not be deemed an approval or recommendation of these products (services or activities) by Media Alliance, except as expressly stated on the Website.
    3. Unless otherwise expressly stipulated by relevant terms of use of certain Website features or sections, where the Website enables the User to download or post any content, the User shall:
      1. Understand and agree that Media Alliance is not obliged to view any content posted and/or distributed by the User through the Website, and that Media Alliance has the right (but not the obligation) to refuse, at its discretion, to post and/or distribute the User’s content, or delete any content that is available through the Website. The User understands and agrees that he/she shall independently evaluate all the risks associated with the use of content, including assessment of its reliability, completeness or usefulness;
      2. Understand and agree that the Website operating technology may require Media Alliance to copy (reproduce) the User’s content, as well as to process it in order to ensure compliance of a certain Website section/feature with the technical requirements.
  1. Final Provisions

5.1.      This Agreement is governed and interpreted in accordance with the applicable laws of the Russian Federation. Any issues not covered by this Agreement shall be resolved in accordance with the applicable laws of the Russian Federation. Any disputes arising out of the relations regulated by this Agreement shall be resolved in accordance with the procedure established by the applicable laws of the Russian Federation and the rules of Russian law. Notwithstanding the foregoing, the User, using the Website, agrees to comply with not only the applicable laws of the Russian Federation, but also with any other legislation that may be applicable depending on his/her citizenship, location, and other circumstances.

5.2.      If one or more of the provisions of this Agreement is found to be invalid or unenforceable for some reasons, this shall not affect the validity or applicability of the remaining provisions of the Agreement.

5.3.      Any waiver by Media Alliance of a breach of the Agreements by the User or other users shall not be deemed to be a waiver by Media Alliance of the right to take appropriate actions in defence of its interests later, nor shall it mean the Media Alliance's abandonment of its rights in the event of any subsequent similar breach.

5.4.      This Agreement was drawn up in Russian. In some cases, it may be provided to the User in another language for review. If there are any discrepancies between the Russian version of the Agreement and its version in another language, the provisions of the Russian version of this Agreement shall prevail.

Privacy Policy

  1. General
    1. Media Alliance Limited Liability Company, incorporated under the laws of the Russian Federation on 11 November 2009, Primary State Registration Number 1097746703130, hereinafter referred to as Media Alliance, processes personal data of the Internet user, who was given a secret login and password to access the Personal Account, which is a protected section of the website with the domain name http://mediaalliance.ru/en  (hereinafter referred to as the User, Personal Account and Website respectively), on the terms and conditions set forth in this Privacy Policy (hereinafter referred to as the Privacy Policy).
    2. Registration of the User on the Website, use of the login and password provided to the User to access the Personal Account, accessing the Personal Account, as well as ticking the box “I have read, understood and hereby accept this Privacy Policy”, or any other similar field on the Website, shall mean the User's unconditional acceptance of the terms and conditions of this Privacy Policy.
    3. Media Alliance may amend this Privacy Policy at any time without any special notice. The new version of the Privacy Policy shall enter into force and effect from the moment it is posted on the Website at the address specified in this paragraph, unless otherwise provided for in the new version of the Privacy Policy. The current version of this Privacy Policy is available at http://mediaalliance.ru/en/confidentiality policy/.
    4. If the User does not accept the terms and conditions of this Privacy Policy or the terms and conditions of the new version of the Privacy Policy, adopted in accordance with paragraph  1.3., the User shall immediately discontinue accessing the Personal Account.
  2. Consent to Personal Data Processing
    1. The User hereby, on his/her own free will and volition, and for his/her own benefit, gives Media Alliance an indefinite consent to processing the following personal data of the User (hereinafter collectively referred to as the Personal Data):
      1. The User’s full name;
      2.  The User’s e-mail; and
      3. Name of the counterparty or partner of Media Alliance (its members, subsidiaries, affiliates, or partners), on whose behalf and/or for whose benefit the User acts (hereinafter referred to as the Counterparty).
    2. The Personal Data is processed in order to enable the User to use the Personal Account features, as well as to send the User notices and messages related to his/her actions in the Personal Account and other communications related to the legal relationship between the Counterparty and Media Alliance.
    3. Since the Personal Data is processed in order to enable the User to use the Personal Account features, the User shall give a consent in accordance with paragraph 2.1 hereof in order to be able to use the Personal Account.  No access to the Personal Account is granted in the absence of such a consent.
    4. Media Alliance processes the Personal Data with or without automation tools. Such processing includes collection, recording, systematisation, accumulation, storage, clarification (updating or modification), extraction and use of the Personal Data.
    5. If the User wishes to withdraw his/her consent given in accordance with paragraph 2.1. hereof, he/she shall give Media Alliance the appropriate notice in writing and discontinue accessing the Personal Cabinet.
    6. Media Alliance shall discontinue processing the relevant Personal Data within five (5) business days of receipt of the User's notice under paragraph  2.5. hereof and delete the relevant Personal Data.
  3. Personal Data Confidentiality
    1. Media Alliance ensures the confidentiality of the User’s Personal Data and applies all the necessary technical measures in order to protect the Personal Data from unauthorised access by third parties.
    2. Media Alliance shall neither disclose nor distribute the Personal Data to third parties, unless otherwise provided by the applicable laws of the Russian Federation.
  4. Final Provisions

4.1.      This Privacy Policy is governed and interpreted in accordance with the applicable laws of the Russian Federation. Any issues not covered by this Privacy Policy shall be resolved in accordance with the applicable laws of the Russian Federation.
